Article 1: scope
The general conditions of sale apply exclusively to current and future commercial relations existing between Diecast Art and its customers. These general conditions of sale aim to specify the rights and obligations of the buyer with regard to the products sold on the store www.diecast-art-photo.com. In the event of an actual order, the contract established falls under the regulations of distance selling. In the event of a dispute, the general conditions of sale applicable are those which were in force at the time of the order.
Article 2: Products
Products may be added or removed from the site without notice. The items offered comply with current European legislation.
The products sold on the Site are numbered art photographs in limited series. The photographs are offered in one or more formats and supports. They are accompanied by a certificate of authenticity in English.
Prices are indicated including all taxes, excluding shipping costs. Only payments in euros are accepted. In the event of delivery to a country other than mainland France, you are the importer of the work(s) concerned. For all works shipped outside the European Union and Overseas Territories, customs duties or other local taxes or import duties or state taxes may be payable.
These rights and sums do not fall within the jurisdiction of Diecast Art. They will be your responsibility and are your entire responsibility both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.
The works will be invoiced on the basis of the prices in force at the time of order registration, subject to availability. The works remain the property of Diecast Art until full payment of the indicated price.
Article 3: Order
We undertake to accept your order under the terms of these general conditions of sale.
To place an order, you must at least go through the following steps:
- Consultation of the file presenting a photograph. On this screen You can choose the format and support from those proposed for this photograph. You must click "Add to Cart" to add this item to your cart.
- “Basket” screen: you can delete an item or modify the quantities ordered. Screens for identification or creation of a customer account.
- Delivery method selection screen. On this screen a link is offered to you to modify the items in your order.
- Summary screen and payment choice. This screen allows you to choose your payment method and check the different elements constituting your order (items, quantity, delivery method, total price). You must ensure that all of these elements comply with your request. Using the links on this screen, you can modify your order.
- You must then accept these general conditions of sale and use of the Site to proceed to the payment stage. The conditions are available for reading and printing from the link entitled “general conditions of use”. Their acceptance is done by checking the box attached to the link to these conditions. The general conditions of sale and use of the Site must be accepted with each order.
- You pay for your order using the chosen payment method
- The contract is concluded upon confirmation of payment by the bank.
- The Site will send you a confirmation of your order by email within a few minutes.
Article 4: Price
The prices indicated in euros are deemed to be inclusive of all taxes, excluding shipping and processing costs for your order. Diecast Art reserves the right to modify its prices at any time,
and we undertake to apply the prices which will have been indicated to you at the time of your order.
Article 5: Payment
Payments must be made by credit card or by bank transfer. All these payment methods are secure.
Article 6: Security of payments
For payments by credit card, the transaction is carried out by stripe, the world leader in internet payment solutions, on the stripe.com website. The User's banking data is encrypted (SSL technology, Secure Socket Layer). They do not circulate unencrypted on the internet and cannot be intercepted. Your banking details (card number, expiration date, etc.) are not communicated to Diecast Art.
Article 7: Proof
The data recorded by the Site constitutes proof of all transactions between the Site and its customers. Data recorded by Stripe.com's Stripe payment system constitutes proof of financial transactions.
Article 8: Delivery terms
The products are delivered to the delivery address you indicate when ordering. Delivery includes the product(s) ordered, packaged and a detailed invoice.
For any package returned to us following an incorrect address, you will be charged a handling fee for the costs of repackaging and returning it. The risks associated with transport are borne by the seller.
When you receive your order, it is your responsibility to open the package to check the condition of the photographs/work of art. If you do not personally receive the package, ask the person responsible for receiving the package to do this check. In the event of a problem, please return your package to the delivery person (La Poste or private carrier) stating the problem encountered and contact our customer service the same day.
Do not sign the delivery note if the order arrived damaged. No complaints will be admissible if the delivery note is signed.
In the case of delivery by private carrier, the carrier is not required to deliver inside your home and can give you the package at the entrance to your building or house.
Receipt of the transported objects extinguishes any action against the carrier for damage or partial loss if within three days, not including public holidays, following that of this receipt, the recipient has not notified the carrier, by extrajudicial act or by registered letter, his protest justified. (art L 133.3 of the Commercial Code).
Article 9: Taxes and customs fees outside the European Union
Items shipped outside the European Union may be subject to taxes, customs duties and other taxes in the destination country, hereinafter referred to as “Import Fees”. The recipient of the order agrees by placing the order to be designated importer of record in the country in which the order is received and is responsible for import costs. For each item imported, you authorize Diecast Art to designate a carrier to act as an intermediary with the competent authorities for the management and payment of import charges in the country of destination. You also agree by placing an order that the carrier can share with Diecast Art the amount of these import costs. In the case of an order placed as an intermediary for another person, you agree to give the above authorizations on behalf of the recipient named in your order. For details of actual import charges, or to obtain customs clearance documents or receipts, you may contact the designated carrier listed in your shipment confirmation.
Article 10: Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good. The consumer may deviate from this deadline if he is unable to travel and at the same time needs to call upon an immediate service necessary for his living conditions. In this case, he would continue to exercise his right of withdrawal without having to provide reasons or pay penalties. The period mentioned in the preceding paragraph runs from receipt for the goods or acceptance of the offer for the provision of services. Any part returned damaged or with signs of wear will not be refunded. The return will remain your responsibility for the management and return costs.
Article 11: Reservation of ownership
The goods delivered will remain our property until you have fulfilled all your obligations towards us and in particular until full payment of the price.
Article 12: Protection of personal data
You have the right to access and rectify information concerning you. To exercise this right, simply send an email from the contact section or write to the address mentioned in article 1. Under no circumstances will we communicate your confidential information.
Article 13: Intellectual property
All texts, visuals, photographs and graphics contained on the site are protected by copyright throughout the world. As such and in accordance with the provisions of the Intellectual Property Code, only private and free representations carried out exclusively within a family circle and copies or reproductions strictly reserved for the private use of the copyist and not intended for collective use are authorized. . In the absence of prior authorization communicated in writing by Diecast Art, any other use constitutes counterfeiting and is punishable by the Intellectual Property Code.
Article 14: Archiving of the contract
Contracts concluded on our website (data relating to your order and T&Cs in force on the day of your order) are archived for a period of 10 years. You can access archived contracts by requesting by email to contact@diecast-art-photo.com
